1) Agreement Between User and Sisters of Sirius

The Sisters of Sirius website(s) (the “Site”) are operated by Sisters of Sirius (“Sisters of Sirius,” “we,” “us,” or “our”). The Site is offered to you conditioned upon your acceptance, without modification, of the terms, conditions, and notices contained herein (collectively, these “Terms”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2) Modification of These Terms

We may change these Terms (and any policies referenced in them) at any time. Updates will be posted on this page with a new effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

3) Links to Third-Party Sites

The Site may contain links to other websites (“Linked Sites”). Linked Sites are not under our control, and we are not responsible for their content, any link contained in a Linked Site, or any changes or updates to a Linked Site. We provide these links only for convenience, and the inclusion of any link does not imply our endorsement of the Linked Site or association with its operators. 4) No Unlawful or Prohibited Use

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. 5) Use of Communication Services

The Site may include bulletin boards, chat areas, news groups, forums, communities, calendars, and/or other message or communication facilities (collectively, “Communication Services”). You agree to use Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service. Without limitation, you agree you will not:

Defame, abuse, harass, stalk, threaten, or otherwise violate others’ legal rights (including rights of privacy and publicity).

Upload files that contain software or material protected by intellectual property laws (or rights of privacy/publicity) unless you own or control the rights or have received all necessary consents.

Upload files containing viruses, corrupted files, or similar software that may damage the operation of another’s computer.

Advertise or offer to sell/buy any goods or services unless the Communication Service specifically allows such messages.

Conduct or forward surveys, contests, pyramid schemes, or chain letters.

Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner.

Falsify or delete author attributions, legal or other proper notices, or proprietary designations.

Restrict or inhibit any other user from using and enjoying the Communication Services.

Violate any applicable code of conduct, guidelines, laws, or regulations.

Harvest or otherwise collect information about others (including email addresses) without consent.

We have no obligation to monitor Communication Services, but we reserve the right to review materials posted and to remove any materials in our sole discretion. We may terminate your access to any or all Communication Services at any time without notice for any reason. We may disclose information as necessary to satisfy applicable laws, regulations, legal processes, or governmental requests, or to edit, refuse to post, or remove information or materials, in whole or in part, in our sole discretion. Always use caution when giving out personally identifying information in any Communication Service.

Materials uploaded to a Communication Service may be subject to posted limitations on use, reproduction, and dissemination. You are responsible for adhering to such limitations.

6) Messaging & Notifications (SMS/MMS)

By enrolling for messaging and notifications with Sisters of Sirius, you may receive appointment updates and reminders. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to cancel. Carriers are not liable for delayed or undelivered messages.

7) Materials Provided to Sisters of Sirius or Posted on the Site

We do not claim ownership of materials you provide to us (including feedback and suggestions) or post, upload, input, or submit to the Site or its associated services (collectively, “Submissions”). However, by posting, uploading, inputting, providing, or submitting a Submission, you grant Sisters of Sirius, its affiliates, and necessary sublicensees a worldwide, nonexclusive, royalty-free license to use your Submission in connection with operating and improving the Site and our services, including the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, reformat, and otherwise use your Submission, and to publish your name in connection with your Submission if you permit us to do so.

No compensation will be paid with respect to the use of your Submission. We are under no obligation to post or use any Submission and may remove any Submission at any time in our sole discretion. By submitting a Submission, you represent and warrant that you own or control all rights necessary for you to provide it and to grant the license above.

CHANGES ARE PERIODICALLY MADE TO THE INFORMATION HEREIN. SISTERS OF SIRIUS AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES TO THE SITE AT ANY TIME.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. 11) Indemnification

You agree to indemnify, defend, and hold harmless Sisters of Sirius, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account or use of the Site (including negligent or wrongful conduct).

12) Termination/Access Restriction

We may, in our sole discretion, terminate or restrict your access to the Site and related services, in whole or in part, at any time, without notice, for any reason or no reason.

13) Governing Law; Venue

To the maximum extent permitted by law, these Terms are governed by the laws of the State of North Carolina, without regard to its conflicts-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina for all disputes arising out of or relating to the Site or these Terms.

14) Miscellaneous

No Agency. Your use of the Site does not create any joint venture, partnership, employment, or agency relationship with Sisters of Sirius.

Compliance with Laws. Our performance is subject to existing laws and legal processes, and nothing in these Terms limits our right to comply with governmental, court, and law-enforcement requests or requirements related to your use of the Site.

Severability. If any part of these Terms is determined to be invalid or unenforceable, the invalid provision will be replaced by a valid, enforceable provision that most closely matches the original intent, and the remainder will continue in effect.

Entire Agreement. These Terms constitute the entire agreement between you and Sisters of Sirius regarding the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

Electronic Communications. A printed version of these Terms and any notices given in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign these Terms at our discretion.

15) Accessibility (ADA) Statement

We are committed to ensuring that our website and services are accessible to all. Sisters of Sirius works to improve accessibility and usability consistent with the Web Content Accessibility Guidelines (WCAG) published by the Web Accessibility Initiative (WAI) of the World Wide Web Consortium (W3C).

Accessibility and usability may not be possible in every area of the Site or for all assistive technologies and devices. Our efforts are ongoing and we welcome feedback. If you encounter an accessibility issue, please specify the web page and describe the problem so we can address it.
